Municipal Separate Storm Sewer System (MS4)

During the July 11, 2017, Trappe Borough Council Meeting, Barry Isett & Associates (the borough engineering firm) gave a public presentation regarding updated MS4 requirements. To see the presentation click here: Storm Water Presentation

After the presentation, the Borough will get a copy of the full draft report. This report will be made available for public review for 30 days. It goes through the full analytical and NPDES permit process, with calculation charts, mapping, funding opportunities and maintenance tasks. The report is considered a draft and any questions, edits, comments received during the public comment period shall be recorded in a log and reviewed for revising into the final report.

SWIFT 911 is a high speed notification program with the capability of delivering recorded messages to our community via telephone, email, text or pager. SWIFT 911 in its simplest form is a system that makes phone calls to specific people or areas in the event of an emergency or for sharing important community information.

Trappe Borough Achievements 2016

  1. Completed a walking path from West Main Street near Borough Hall to Rambo Park. The majority of the project was funded through grants.

 

  1. Economically developed and released a new TrappeBorough.com website with PA State Association of Boroughs use of state of the art software.

 

  1. Repaved Joan Drive (.62 miles). Assisted 23 Joan Drive residents replace curb depressions prior to the Borough roadwork.

 

  1. Repaved the majority of Linden Drive and Linden Street (.15 miles).

 

  1. Seal coated and relined Borough Hall and Rambo Park parking lots, and replaced broken concrete sidewalk at Borough Hall.

 

  1. Updated the Trappe nine year Road Maintenance Schedule and incorporated five years into our 2017-2021 year financial plan.

 

  1. Reestablished a contingency fund of $250,000 for any unanticipated future infrastructure expenditures.

 

All of the above were accomplished without raising municipal real estate taxes.  Trappe Borough maintains its status as having the third lowest municipal real estate tax in Montgomery County.

Conditional Use [§340-27]

The VC Village Commercial District is intended to establish reasonable standards for a variety of residential and nonresidential uses within the Main Street village corridor.

A Conditional Use Application is required if you own a property located in the Village Commercial District and you would like do any of the following:

  1. Change to operate a business anywhere on a property that is currently a being occupied as a residential property.
  2. Change from existing use classification to a different classification. For example, changing the use from personal services to a retail shop.
  3. Change from a single use to a mixed use. For example, changing from a personal services classification to a combined use of retail and personal services, or any combination of uses.

It is important to note that each building has an existing use. You may use the premises only under the terms of the existing use. If you would like to change the use or offer additional uses, even though they may be listed as “approved uses”, you must apply for a Conditional Use and obtain approval by Borough Council before you may begin offering any of those additional services.

Conditional Use Procedure

  1. All Conditional Use applications shall be made in writing on the Conditional Use Application form and shall be in accordance with the Trappe Borough Zoning and Subdivision & Land Development Ordinances and the Pennsylvania Municipalities Planning Code.
  2. The completed Conditional Use Application, with all required fees, site plans and additional information shall be submitted to the Zoning Officer. Applicant is responsible to see that a Borough official notes the date of receipt on the Conditional Use Application. Applicant(s) must submit to the Borough thirty (30) copies of the application, plans, drawings, documents, diagrams, photographs and/or any other information to be submitted for review to the Borough. For all commercial properties Applicant is required to submit plans prepared by a Pennsylvania certified engineer, architect or plan designer that have been signed and sealed.
  3. A complete application is achieved when all fees are paid, site plans comply with all regulations with all appropriate submission procedures, and relevant sections of the Conditional Use Application are fully completed. All materials must be received on or before the submission deadline. If an application is not fully completed, the application will not be accepted.
  4. SUBMISSION DEADLINE FOR ALL CONDITIONAL USE APPLICATIONS – All Conditional Use applications must be filed thirty-five (35) days prior to the regularly scheduled Planning Commission meeting. There are no exceptions to this filing date. If the Conditional Use application is not filed within the aforementioned time frame, the Conditional Use appeal application will be heard the following month.
  5. Upon receipt of the complete Conditional Use Application, the Zoning Officer will review the Conditional Use Application and will forward his or her review along with a full and complete copy of the application and supporting documentation to the following for their review and consideration: Trappe Borough Planning Commission Members; Borough Engineer; Borough Solicitor; Fire Marshal; Fire Chief; Public Works Director; Montgomery County Planning Commission; and PA State Police.
  6. Applicant(s) will be notified in writing by the Zoning Officer of the date and time of the next regularly scheduled Planning Commission Meeting during which the Conditional Use Application will be considered. Applicant(s) and/or their representatives must be in attendance.
  7. The Borough shall request the review and recommendations of the Trappe Borough Planning Commission prior to the public hearing.
  8. The Borough shall request, prior to a public hearing, the review and recommendations of technical agencies such as the Montgomery County Planning Commission and other planning agencies as necessary to assist in determining the environmental impact of the proposed use(s).
  9. Borough Council will schedule a public hearing within 60 days after the application was first filed. Public notice of the hearing shall be given in accordance with PA Municipalities Planning Code (MPC) §908. Applicant(s) and/or their representative are required to be present for the hearing.
  10. The Borough will post a notice on the property a minimum of seven (7) days before the hearing. The Applicant is responsible for the maintenance of the notice. If the notice is removed or destroyed, the property owner must immediately obtain another notice and conspicuously post it.
  11. Borough Council is permitted forty-five (45) days to render a written decision following the last hearing. A signed copy of the written Findings of Fact and Order will be sent by certified mail to the Applicant(s) not later than the day following its date.
  12. In rendering a decision, the Borough may impose special measures or conditions as deemed reasonably necessary and appropriate for the proposed use(s) to conform with the Trappe Borough Zoning Code.
  13. If Applicant(s) has been granted the Conditional Use the next step is to obtain any and all required permits.

Conditional Use Application Process

  1. Complete, sign and date the application. Applicant is required to submit thirty (30) copies of the completed application to the Borough.
  2. Under the provisions of the MPC only an equitable landowner or a tenant with written
    permission of the landowner shall file a Conditional Use Application. Applicant(s) must include a copy of the deed and latest Agreement of Sale with the application.
  3. Applicant must provide a written response to each of the conditional use criteria questions and conditional use requirement questions enumerated on pages 4 through 9 of the Conditional Use Application. Applicant is required to submit thirty (30) copies of the written responses to the Borough.
  4. Applicant must submit to the Borough thirty (30) copies of plans, drawings, documents, diagrams, photographs and/or any other information to be submitted for review to the Borough. For all commercial properties Applicant is required to submit plans prepared by a Pennsylvania certified engineer, architect or plan designer that have been signed and sealed.
  5. Applicant must pay the required application and escrow fees. All checks must be payable to “Trappe Borough”. For applicable fees, please refer to the current year Trappe Borough Fee Schedule.
  6. Applicant must sign, date and submit the Escrow Agreement along with their escrow payment as per the current year Trappe Borough Fee Schedule.
  7. Please read the application carefully. You must submit all required documents with your application or it will be returned to you.
  8. Important Note: If you are a contractor or individual submitting a permit application on behalf of the property owner you must submit an Owners Authorization Form with the owner’s original signature. The Borough will not accept faxed copies because the form must have the property owner’s original signature. If this form is not included with your permit application submission, the application will not be accepted. If you are the property owner and you are submitting the application on your own, you are not required to include this form.
  9. ALL ITEMS MUST BE RECEIVED AT LEAST THIRTY-FIVE (35) DAYS BEFORE THE PLANNING COMMISSION’S ADVERTISED MONTHLY MEETING TO BE INCLUDED ON THAT MEETING’S AGENDA.

Permitted Uses [§340-29]

The following uses are permitted only when approved by Borough Council as conditional uses, in compliance with the intensity and dimensional standards in the Trappe Borough Code §340-31 and §340-32 and the conditional use standards.
It is important to note that each building has an existing use. You may use the premises only under the terms of the existing use. If you would like to change the use or offer additional uses, even though they may be listed as “approved uses”, you must apply for a Conditional Use and obtain approval by Borough Council before you may begin offering any of those additional services.

  • CLASS 1 USES:

    1. Two or more dwelling units in one building or on one lot, excluding townhouses.
    2. Group day-care home or day-care center.
    3. Group home, club, lodge or residential club.
    4. Hotel, inn or restaurant, not including fast food.
    5. Offices, retail shops or personal service shops.
    6. Bank or financial institution.
    7. Repair shop for electronic equipment and/or small appliances (carry-in).
  • CLASS 2 USES:

    1. Funeral home.
    2. Place of worship, school.
    3. Nursing home, personal care facilities, hospital, sanitarium, public residential institution.
    4. Borough administrative building, community center, public park or any similar use.
  • ACCESSORY USES:

    1. Accessory uses customarily incidental to the uses listed above, including home occupations.

Prohibited Uses [§340-30]

The following uses are strictly prohibited:

  1. Outdoor display, sales or storage of materials or equipment, except for garden shops/nursery stock, when placed to the rear or side of buildings.
  2. Manufacturing.
  3. Gas stations of any kind.
  4. Indoor and outdoor places of amusement, such as, but not limited to arcades and miniature golf.
  5. Automobile or other vehicle sales, service, storage and/or repair agencies for new, used or junk vehicles.
  6. Convenience food stores.
  7. Beverage distributors.
  8. Car washes.
  9. Building supplies, mini warehouses.
  10. Adult uses.
  11. Industrial uses.
  12. Fraternity house.
  13. Uses of a similar nature to the uses listed above

Conditional Use Requirements [§340-15]

Whenever an application for use is subject to conditional use requirements, the following shall be applicable:

  • Procedures. Plans for conditional use shall be submitted to the Borough Council in accordance with Chapter 295, Subdivision and Land Development, as well as applicable sections concerning said use under this chapter.
  • Standards and criteria for conditional use. In acting on a request for a conditional use, the Borough Council and Planning Commission shall consider the impact of the requested conditional use on the Borough and all facilities and systems as listed below. The applicant shall provide all of the information, data and studies needed to allow the Borough Council and Planning Commission to reach conclusive evaluations of the items listed below:
    1. The compatibility of the proposed development with existing and proposed land uses adjacent to the site.
    2. The impact on the Borough transportation network and the ability of adjacent streets and intersections to efficiently and safely move the volume of traffic generated by the development.
    3. The impact on the Perkiomen Valley School District, including an estimate of new pupils generated by the proposed development and their impact on classroom capacities, class sizes, existing or planned facilities.
    4. The impact on the Borough’s community facilities including estimates of additional community facilities which will be needed to serve the proposed conditional use and estimates of the abilities of existing commercial facilities to meet the demands generated by the proposed conditional use.
    5. The impact on the economy of the Borough and region including an analysis of the work locations of the residents of the proposed development.
    6. The impact on the Borough’s community facilities, including estimates of additional community facilities which will be needed to serve the proposed conditional use. Community facilities include but shall not be limited to sewage disposal facilities and systems, solid waste disposal facilities and systems, water supply facilities and systems, storm drainage systems and electrical utility facilities and systems.
    7. The ability of the Borough to provide police and fire protection to the proposed conditional use.
    8. The impact on the Borough’s recreation facilities including estimates of additional facilities which will be needed to serve the conditional use.
    9. A cost revenue analysis which shall identify the net cost of the proposed conditional use to the Borough and to the Perkiomen Valley School District. The net cost shall be the difference between the governmental expenditures which will be required to serve the proposed conditional use and the revenues that it will generate. The cost analysis shall clearly identify whether a net gain or a net loss is anticipated and shall itemize the measurements used in the evaluation.
  • Findings.
    1. The Borough Council shall consider the recommendations of the Borough Planning Commission before granting or denying tentative approval of a development plan.
    2. The Borough Council shall by official communication to the applicant either:
      1. Grant tentative approval of the plan as submitted;
      2. Grant tentative approval subject to specified conditions and included in the plan as submitted; or
      3. Deny tentative approval of the plan.
    3. The Trappe Borough Council may further attach such reasonable conditions and safeguards, in addition to those expressed in this chapter, as it may deem necessary to implement the purposes of the Pennsylvania Municipalities Planning Code as well as the purposes and objectives of this Trappe Borough Zoning Code.

What is considered Public Information?

In accordance with the Pennsylvania Right-to-Know Law (Act 3 of 2008) all records maintained by Trappe Borough are public records, unless the records are (a) specifically exempted by Section 708 of Act 3, (b) exempted by another state or Federal law, and/or (c) exempted by a judicial decree or order.

How Do I Request Public Information?

To request a public record complete a Right-to-Know Request Form, and submit this to the Borough’s Open Records Officer. Requests for information may likewise be directed to the Open Records Officer via e-mail, fax or telephone, or the request may be delivered to Borough Hall. But please note: while the Borough may fill anonymous or verbal requests for information, relief and remedies under the Act are available to only to persons submitting a written request for information.

What Happens After I Submit A Request For Public Information?

All requests for information are filled in accordance with the Pennsylvania Right-to-Know Law (Act 3 of 2008). Most notably, a response to each request will be provided within five business days of the filing of the request. Service Fees

The Borough does not charge a fee to locate the public information (i.e., employee time), but the Borough does charge nominal duplication fees as approved by the Pennsylvania Office of Open Records. In addition, the Borough charges actual postage fees if the public information is mailed to the requestor.
Per the Act, the Borough reserves the right to require pre-payment of fees when fees are estimated to exceed $100.00. The Borough reserves the right to waive any fee.

Road Program

The Borough of Trappe has a Road Maintenance Program whereby all Borough owned roads are on a multiyear maintenance schedule.

The Borough’s program over the past five years included:

  • 2016 resurfacing of Joan Drive, Linden Drive and Linden Street
  • 2015 resurfacing of a portion of Cherry Avenue and all of E. Seventh Avenue
  • 2014 resurfacing, rebuilding and improved drainage of Borough Line Road from W. Seventh Ave. to Route 113 with improvements to the intersection with Route 113
  • 2013 resurfacing of W. Fifth Avenue with improvements to the intersection with Borough Line Road
  • 2012 resurfacing of E. College Avenue, W. College Avenue and E. First Avenue

Prior to repaving the underground storm sewers are videoed so any needed repairs can be identified.  Public water and sewer infrastructure is also evaluated so any required work can also be completed prior to the final paving.

Curb repair and maintenance is the responsibility of the property owner. (See, TBC §286-14). As the road maintenance work gets underway, property owners should know that if you have damaged curbs along your property repairs will need to be made.   As a last resort, the Borough’s contractor will make the necessary repairs and the property owner will be invoiced for the repair work based on the bid price per linear foot of curb replacement.

The Road Program Schedule is subject to change depending on current circumstances. The Borough will advise residents of any changes. Residents should plan ahead to be prepared to make the necessary curbs repairs in a timely manner. Tax Certifications & Duplicate Bill Fee

Please note that tax certification and duplicate bill requests must be requested through the Tax Collector. Borough Hall staff does not have access to tax records and unfortunately we are not able to assist with these requests.

The fee for up to a 4 year Tax Certification is $25.00. Tax certification includes County, Borough and School Real Estate. Please allow 5 business days for processing. Checks should be made payable to “Gretchen Lawson”.  Requests should be emailed to trappetax@hotmail.com.

Fee for Furnishing Information: There shall be a fee of $5.00 per year for furnishing and providing, by mail or otherwise, information pertaining to real estate tax data, where no tax certification is requested, including, but not limited to, tax duplicates, for any single tax parcel within the Borough of Trappe.

Real Estate Tax

As of January 1, 2013 Trappe Borough implemented a real estate tax of .47 mils. Portions of the total Real Estate Tax bill are delivered to Montgomery County and Perkiomen Valley School District, a portion does now remain with the Borough. The .47 mils Real Estate Tax that supports Trappe Borough is primarily used for road rehabilitation projects.

Earned Income Tax

Trappe Borough has a 1.4% Earned Income Tax (EIT) which is levied on wages and salaries of individuals who live in Trappe Borough. Perkiomen Valley School District receives .9% of this tax and Trappe Borough receives .5%. The Earned Income Tax is collected by Berkheimer Associates.

Local Services Tax

Trappe Borough levies an annual $52.00 Local Services Tax (LST) from employees working in the Borough. The Local Services Tax is collected by Berkheimer Associates.

Meeting Schedules

Borough Council

Borough Council meets at 7:00 p.m. on the first Tuesday of each month. In months when the regularly scheduled meeting is in conflict with a holiday, the meeting is held on the second Tuesday. Meetings are held at Trappe Borough Hall, 525 West Main Street.

Collegeville Trappe Joint Public Works

Meetings are held the fourth Tuesday of each month at 7:00 p.m. During 2017 the meetings are held at Trappe Borough Hall, 525 West Main Street, Trappe, PA 19426.

Collegeville Trappe Municipal Authority

Meetings are held the fourth Tuesday of each month at 7:00 p.m. During 2017 the meetings are held at Trappe Borough Hall, 525 West Main Street, Trappe, PA 19426.

Planning Commission

The Trappe Borough Planning Commission meets on the third Tuesday of each month, as needed. Work session begins at 6:30 p.m. and is open to the public. Zoning Hearing Board

The Zoning Hearing Board meets on an as needed basis. Meetings are held at Trappe Borough Hall, 525 West Main Street, Trappe, PA 19426.

Central Perkiomen Valley Regional Planning Commission

The Central Perkiomen Valley Regional Planning Commission meets on the third Monday of every month (except for December, when there will be no meeting). The location of the monthly meetings alternates between the member municipalities on an annual basis. Building Permits

Most changes that a property owner might wish to make to a building or other structure will require a permit and inspections to ensure safe construction. Inspections are conducted pursuant to the PA Uniform Construction Code which was adopted by Borough Council in 2004 (ref. Borough Code §135 Article VI). Plumbers Registration

All Plumbers are required to register with the Borough, even if you are already registered with the State. Without a valid Trappe Borough Plumber Registration you will not be permitted to do plumbing work in the Borough.

Please complete the Plumber’s Registration below in its entirety and submit it to the Borough with the applicable fee. If all is in order you will be issued a Trappe Borough Plumber Registration within 48 hours.

Solicitation Permits

Trappe Borough requires any person, entity or organization who wishes to engage in the selling, soliciting or peddling of goods, food, services and/or printed matter within the Borough of Trappe must first obtain a Solicitation Permit. An organization must apply for one permit for each individual soliciting in the Borough. Each individual must apply for a Solicitation Permit in person and provide a valid form of picture identification.

You are required to carry your Solicitation Permit at all times and exhibit it upon request to any peace officer or any person upon whom you make contact.

The hours of solicitation in Trappe Borough are between 10:30 a.m. and 8:00 pm.

Zoning Permits

Zoning Permits are in place to “promote the health, safety, morals and the general welfare of the Borough in accordance with a comprehensive plan … and to encourage the most appropriate use of land throughout the Borough.” Please refer to Trappe Borough Code §340.80-82 for detailed Zoning Permit information. Pre-Plan Submission

You may engage the Borough Engineer, Borough Solicitor, Zoning Officer and/or the Building Code Official to review your plans. If you would like to have your plans reviewed prior to your plan submission, or if you would like to meet with any of the above professionals to discuss a potential project, you will need to submit a Professional Services Application and Escrow Agreement and set up the escrow funds. All fees associated with your plan review and/or meetings with any or all of the above mentioned Borough professionals will be paid out of your escrow funds. Please make certain you submit all required documents with your application.

If you are submitting single lot construction plans for review, you will need to fill out the Single Lot New Construction Application for Plan Review and Escrow Agreement below and set up your escrow funds. All fees associated with your plan review from and or all of the above mentioned Borough professionals will be paid out of your escrow funds. You must submit all required documents with your application.

Overlay District

An overlay district is a district superimposed upon another district which supersedes, modifies or supple¬ments the underlying regulations.

Overlay zoning is a regulatory tool that creates a special zoning district, placed over an existing base zone(s), which identifies special provisions in addition to those in the underlying base zone. The overlay district can share common boundaries with the base zone or cut across base zone boundaries. Regulations or incentives are attached to the overlay district to protect a specific resource or guide development within a special area.

Common requirements may include building setbacks, density standards, lot sizes, impervious surface reduction and vegetation and landscape buffering requirements. Structure requirements could include building floor height minimums and flood-proofing to high water level.

OVERLAY DISTRICT APPLICATIONS

Rental Property Inspection

Rental Program

Trappe Borough conducts regular inspections of residential rental units. The foremost goal of this program is public safety, helping to ensure that apartments and other rental units are maintained in accordance with current building and property codes. In addition to safeguarding residents living in rental units, the program will help to protect property values throughout the Borough. Rental properties not subject to regular inspections are more likely to deteriorate over time. Neglected properties, in turn, lower the value of neighboring homes.

Prior to the adoption of the program, rental units in the Borough were only inspected when a rental property changed ownership. And because some rental properties can be held by the same corporation or individual for several decades, rental units could go many years without an inspection. Now, rental units will be inspected every time there is a change of tenants, or every three years, whichever occurs first.

Owners of rental properties created after January 1, 2009 will pay a one-time registration fee of $100 per property. To register your property, please use the Rental Property Registration.

After the rental property is registered, each rental unit must pass inspection. Inspections are scheduled with a Rental Inspection Checklist. A general list of items that will be looked at during Residential Rental inspections is available at Borough Hall and/or on our website located with other Residential Rental documents.

IMPORTANT NOTE: On or before April 1st of each year property owners and/or managers must submit a completed “Annual Tenancy Report” to the Borough for each Residential Rental Property owned. There is no fee due for this. The form is available below and may be faxed, emailed, or sent via US mail.

What is considered Public Information?

In accordance with the Pennsylvania Right-to-Know Law (Act 3 of 2008) all records maintained by Trappe Borough are public records, unless the records are (a) specifically exempted by Section 708 of Act 3, (b) exempted by another state or Federal law, and/or (c) exempted by a judicial decree or order.

How Do I Request Public Information?

To request a public record complete a Right-to-Know Request Form, and submit this to the Borough’s Open Records Officer. Tax Certifications & Duplicate Bill Fee

Please note that tax certification and duplicate bill requests must be requested through the Tax Collector. Borough Hall staff does not have access to tax records and unfortunately we are not able to assist with these requests.

The fee for up to a 4 year Tax Certification is $25.00. Tax certification includes County, Borough and School Real Estate. Please allow 5 business days for processing. Checks should be made payable to “Gretchen Lawson”.  Requests should be emailed to trappetax@hotmail.com.

Fee for Furnishing Information: There shall be a fee of $5.00 per year for furnishing and providing, by mail or otherwise, information pertaining to real estate tax data, where no tax certification is requested, including, but not limited to, tax duplicates, for any single tax parcel within the Borough of Trappe.

Real Estate Tax

As of January 1, 2013 Trappe Borough implemented a real estate tax of .47 mils. Portions of the total Real Estate Tax bill are delivered to Montgomery County and Perkiomen Valley School District, a portion does now remain with the Borough. The .47 mils Real Estate Tax that supports Trappe Borough is primarily used for road rehabilitation projects.

Earned Income Tax

Trappe Borough has a 1.4% Earned Income Tax (EIT) which is levied on wages and salaries of individuals who live in Trappe Borough. Perkiomen Valley School District receives .9% of this tax and Trappe Borough receives .5%. The Earned Income Tax is collected by Berkheimer Associates.

Local Services Tax

Trappe Borough levies an annual $52.00 Local Services Tax (LST) from employees working in the Borough. The Local Services Tax is collected by Berkheimer Associates.

Trash and Recycling are collected every Wednesday in the Borough of Trappe.

Bulk Trash Collection

Bulk items are collected on the last collection day of each month. Residents may dispose of one item per month at no cost. Residents who wish to dispose of more than one bulk item per month may contract for this service with Advanced Disposal by calling 610-440-3700.

Special pickups must be arranged in advance for collection of any Freon containing appliance or any bulk item over the limit of one per month. Payment may be made over the telephone for the bulk items through our Customer Service 610-440-3700.

PLEASE NOTE THE FOLLOWING:

A mattress and box spring are considered one bulk item.

Any individual part of a sectional couch is considered one bulk item. For example, if there are three pieces to your sectional you may only dispose of one.

You will be charged a fee of $40.00 for each bulk item that possesses Freon.

Compost Site Schedule

The Compost Site is located at 233 W. Seventh Avenue. All are invited to pick-up composted materials at no cost. Only residents of Trappe or Collegeville may dispose of waste. Please remember to bring proof of residency and photo identification!

Holiday Trash Collection Schedule

In 2017, Trash & Recycling pick up will be on Thursday instead of Wednesday on the following holiday weeks: Memorial Day, July 4, Labor Day, Christmas and New Years Day, 2018.

Prescription Drug/Medicine Disposal

Montgomery County has established permanent locations where the public may conveniently and responsibly dispose of unused and unwanted prescription drugs throughout the year at no cost. Needles and other sharp items are not accepted at these sites. Please do not flush medication down the toilet or sink and do not bring medication to household hazardous waste collection events. Trappe Borough residents may take their unwanted prescription drugs and medications to the Limerick Police Department, 646 West Ridge Pike, Limerick, PA Monday through Friday from 8:00 a.m. to 4:00 p.m. for proper disposal. Recycling Bins

Recycling bins may be purchased at Borough Hall. The cost is $11.00 for each bin. The Borough does not accept credit cards. You may purchase a recycling bin by cash or check with a valid form of identification.

Use & Occupancy

All new and resale homes and businesses in the Borough of Trappe require a valid “Use & Occupancy Certificate” to be in possession of the new property owner before the structure may be inhabited or used as a business.

A general checklist of items that will be looked at during Use & Occupancy inspections is available at Borough Hall and on our website.

PLEASE NOTE: If the person making application for a “Use & Occupancy Certificate” is not the current property owner, an “Owner’s Authorization” form bearing the property owner’s original signature must be included with the application. ONLY ORIGINAL SIGNATURES ACCEPTED – Forms that have anything other than the original signature of the property owner (i.e. faxed, e-mailed, or containing an e-signature) will be denied and returned for correction and re-submission.

Failure to complete the process necessary to obtain a “Use & Occupancy Certificate” prior to settlement/taking possession of the structure can potentially have negative outcome as follows: (1) fines will be issued in accordance with the current year’s Fee Schedule; and (2) being served with a Cease and Desist Order requiring evacuation of the premises until a valid Use & Occupancy Certificate has been issued.

Zoning Hearing Board

Applications and Forms

Zoning Hearing Board

The Zoning Hearing Board is a quasi-judicial body comprised of three members, all of whom are appointed by Borough Council and must be residents of Trappe Borough. The Zoning Hearing Board conducts legally binding hearings and renders decisions on appeals, variances, and special exceptions to the Borough’s Zoning Ordinance.

All building permit applications are reviewed by the Borough’s Zoning Officer. If the proposed project does not meet the requirements of the Borough Zoning Code, the Applicant will be referred to the Zoning Hearing Board to apply for a variance or special exception. The most common requests for variances are when a proposed addition exceeds allowable lot coverage or does not meet the setback requirements.

Application Process

All Zoning Hearing Board Applications to the Trappe Borough Zoning Hearing Board shall be made in writing on the Zoning Hearing Board Application form provided by Trappe Borough and shall be in accordance with the Trappe Borough Zoning Ordinance §340-82 and the Pennsylvania Municipalities Planning Code (herein called the MPC). The completed application, with all required fees, required site plans, property labels and with other required information, shall be submitted to the Zoning Officer. The Applicant is responsible to see that a Borough Official stamps the date of receipt on the Zoning Hearing Board Application.

Under the provisions of the MPC §913.3 only a landowner or a tenant with written permission of the landowner shall file a Zoning Hearing Board Application with respect to a request for a variance and/or special exception. Other appeals may be filed with the Zoning Hearing Board under the MPC §913.3 by the landowner affected, the municipality or any person aggrieved.

Application Instructions

  1. Application: Complete the Information Sheets (pages 2, 3 & 4), Application Narrative, Items 1, 2, 3 and 4 (pages 5, 6, 7 & 8), in their entirety. Please sign and date the application (page 8) and submit ten (10) complete copies to the Borough.
  2. Plan Submission Requirements:Submit to the Borough ten (10) copies of any plan, drawing, document, diagram, photograph and any other information to be presented to the Zoning Hearing Board. See Plan Submission Requirement Sheet
  3. Mailing Labels:Mailing Labels: Submit to the Borough three (3) sets of mailing labels that include the following:
    • All owner(s), current tenant(s) and/or occupants for all properties/lots located on both sides of the same street within 500 feet of the subject property/lot or building; and
    • All owner(s), current tenant(s) and/or occupants for all properties/lots located NOT on the same street but within a 150 foot radius, which would include properties in front, catty cornered and behind on all sides of the subject property/lot or building.
  4. Proof of Ownership:If the Applicant is owner of the property in question, please attach a copy of the Deed to the property; if the Applicant is owner of equitable title, or tenant with permission of owner of legal title, please attach proof of equitable ownership or lease.
  5. Owner’s Authorization:When an APPLICANT is NOT the owner of record, an “Owner Authorization” form must be completed by the OWNER(s), and the form with the owner’s original signature must be submitted with the application. Faxed forms are not acceptable. See, Owner Authorization form.*Under the provisions of the MPC §913.3 only a landowner or a tenant with written permission of the landowner shall file a Zoning Hearing Board Application with respect to a request for a variance and/or special exception. Other appeals may be filed with the Zoning Hearing Board under the MPC §913.3 by the landowner affected, the municipality or any person aggrieved.
  6. Application Fees:The permit fee must be submitted with the application. See the Trappe Borough Fee Schedule for application fees. Please note that the Fee Schedule is updated annually. Accordingly, please make sure you are using the current year Fee Schedule. Checks should be made payable to the “Borough of Trappe”.

Variances

I. What is a Variance?

A variance is a means of solving the problems created by attempting to apply the general terms of the Zoning Ordinance to fit the land which is regulated. It is necessary because a zoning requirement may prevent any use of a property if strictly applied. A variance procedure prevents problems in applying general legislation to specific situations. All Zoning Ordinances contain many detailed pre-set regulations designed to be self-executing. Various setbacks and height limitations are examples of these provisions, which omit administrative discretion. Variances act as means of possible a relief from the Zoning Ordinance.

A request for a variance arises when an application for a zoning or building permit is rejected or “turned down” by the Zoning Officer because the proposed activity does not meet all the requirements of the Zoning Ordinance. The Applicant(s) would then make application to the Zoning Hearing Board for a variance as a result of this denial. The Zoning Hearing Board has the authority to vary the terms of the Zoning Ordinance in proper instances.

Any person aggrieved by any decision of the Zoning Hearing Board, or any taxpayer, or any officer of the Borough, may within 30 days after any decision of the Zoning Hearing Board is rendered, appeal to the Court of Common Pleas of Montgomery County.

II. Applying for a Variance

All building and zoning permit applications are reviewed by the Borough’s Zoning Officer. If the proposed project does not meet the requirements of the Borough Zoning Code, the Applicant(s) will be referred to the Zoning Hearing Board to apply for a variance. The most common requests for variances are when a proposed addition exceeds allowable lot coverage or does not meet the setback requirements.

III. Requirements for a Variance [MPC §910.2]:

  1. The Zoning Hearing Board hears requests for variances where it is alleged that the provisions of the Zoning Ordinance inflict unnecessary hardship upon the Applicant. The Zoning Hearing Board may by rule prescribe the form of application and may require preliminary application to the Zoning Officer. The Zoning Hearing Board may grant a variance provided the following findings are made where relevant in a given case:
    • That there are unique physical circumstances or conditions, including irregularity, narrowness or, shallowness of lot size or shape, or exceptional topographical or other physical conditions peculiar to the particular property, and that the unnecessary hardship is due to such conditions, and not the circumstances or conditions generally created by the provisions of the Zoning Ordinance in the neighborhood or district in which the property is located;
    • That because of such physical circumstances or conditions, there is no possibility that the property can be developed in strict conformity with the provisions of the Zoning Ordinance and that the authorization of a variance is therefore necessary to enable the reasonable use of the property;
    • That such unnecessary hardship has not been created by the Applicant(s);
    • That the variance, if authorized, will not alter the essential character of the neighborhood or district in which the property is located, nor substantially or permanently impair the appropriate use or development of adjacent property, nor be detrimental to the public welfare; and
    • (5) That the variance, if authorized will represent the minimum variance that will afford relief and will represent the least modification possible of the regulation in issue.
  2. In granting any variance, the Zoning Hearing Board may attach such reasonable conditions and safeguards as it may deem necessary to implement the purposes of the Zoning Ordinance.

Special Exceptions

I. What is a Special Exception?

A special exception is a use permitted within a zoning district, but subject to certain specific conditions.

A special exception is a type of permission or approval granted an Applicant to use land in a district for a purpose other than that generally permitted outright in that district. The permission or special exception is granted by the Zoning Hearing Board in accordance with the standards contained in the Zoning Ordinance, provided that the specific application of the use would not prove injurious to the public interest.

It is important to realize that the term “special exception” is a misnomer. It is neither special nor is it an exception. It is not a deviation from the Zoning Ordinance. An Applicant for a special exception is following the Zoning Ordinance. The application is one envisioned by the ordinance, and, if the standards established by the ordinance are met, the use is one permitted by the ordinance.

II. Applying for a Special Exception [MPC §912.1]:

Where the governing body, in the Zoning Ordinance, has stated special exceptions to be granted or denied by the board pursuant to express standards and criteria, the Zoning Hearing Board shall hear and decide requests for such special exceptions in accordance with such standards and criteria. In granting a special exception, the Zoning Hearing Board may attach such reasonable conditions and safeguards, in addition to those expressed in the ordinance, as it may deem necessary to implement the purposes of this act and the Zoning Ordinance.

III. Regulations for a Special Exception [TBC §340-116]:

Where a permitted use is authorized pursuant to the jurisdiction of the Zoning Hearing Board of the Borough of Trappe, the Zoning Hearing Board is empowered to grant permission for “special exceptions,” consistent with the public interest, in specifically considering the standards in TBC §340-116 A – J, which standards must be met, where applicable, with the Applicant(s) having the burden of proof.

FEES [TBC §340-94]

All Applicants shall pay to Trappe Borough the required fee in accordance with the Fee Schedule which is approved and adopted by Resolution by the Trappe Borough Council. Please see the current year Fee Schedule for the fee amount. The Fee Schedule is updated annually. Please be sure to use the current year Fee Schedule. Checks should be made payable to the BOROUGH of TRAPPE.

HEARING PROCEDURE & POLICY [TBC §340-91]

The Zoning Hearing Board meets on demand at Borough Hall, 525 W. Main Street, Trappe, PA 19426. Notice of hearing shall be given in accordance with the Zoning Ordinance §340-91 and the PA Municipalities Planning Code §908.

A complete application requires that all fees are paid, site plans comply with all regulations with all appropriate submission procedures and relevant sections of the Zoning Hearing Board Application are fully completed. All materials must be received at the time of submission. If an application is not fully completed, the application will not be accepted.

Upon receipt of the completed Zoning Hearing Board Application the Zoning Hearing Board shall schedule a reasonable time and date for a public hearing and shall provide a minimum of a ten (10) day notice thereof as follows:

  • Publish a Notice of the Public Hearing twice in a local newspaper of general circulation.
  • Serve written notice to the Applicant(s) by U.S.P.S. regular first-class mail.
  • Serve written notice to the Borough by U.S.P.S. regular first-class mail.
  • Serve notice to all property owners within 500 feet on the same street as the subject property will be provided by the Borough; and, notice to all property owners within a 150 foot radius of the subject property, not on the same street, will be provided by the Borough using labels submitted by Applicant(s) along with the ZHB Application. All notices sent by the Borough to these property owners shall be by U.S.P.S. regular first-class mail.

In addition, notice of such hearing shall be conspicuously posted on the affected tract of land by Trappe Borough a minimum of seven (7) days before the hearing. The Applicant(s) is responsible for the maintenance of the notice. If the notice is removed or destroyed, the property owner must immediately obtain another notice and conspicuously post it. [MPC §908(1)].

Decision Rendered By ZHB [MPC 908(9)]

The Zoning Hearing Board is permitted forty-five (45) days to render a written decision following the last hearing. A signed copy of the written decision will be sent by certified mailed to the Applicant(s) no later than the day following its date of execution.

Please note: As required by the MPC, Building and Zoning Permits cannot be issued until the written Decision is received by the Applicant(s) and the Borough of Trappe.

Appeal Decision to Court [TBC §340-93]

Applicant(s) shall have a right of appeal to the Court of Common Pleas of Montgomery County within thirty (30) days after the entry of the decision, or, in case of a deemed decision, within 30 days after the date upon which notice of said deemed decision is given as set forth in Section 908(9) of the MPC.

Interpretation of the Zoning Officer’s Determination [MPC 614]

The Zoning Officer must administer the Zoning Ordinance by its literal terms: the Zoning Officer does not have any discretionary power and/or authority to waive, tighten nor create any requirement for any Trappe Borough Ordinance. Occasionally, the Zoning Officer in his or her capacity cannot make a literal determination of the particular zoning ordinance in which the Applicant requires a decision. The Zoning Officer is then required by the MPC to refer this determination to the Zoning Hearing Board for decision.
